Terms and Conditions

 

 

  1. General

 

  1. The promoter responsible for the publication and adjudication of this Competition and the provision of the prizes is Coty Ireland Ltd, Unit A1 Nutgrove Office Park, Nutgrove Avenue, Rathfarnham, Dublin 14 (“Promoter”).

           

By entering this competition, Entrants will be deemed to be bound by and agree to the current and applicable terms and policies imposed by Instagram and the following terms and conditions of the competition stated below:

 

1.2 Entrants confirm by their entry that:

  • By entering this Competition entrants are providing their information to the Promoter. The information provided will only be used to contact entrants if they are potential winners. Any questions, comments or complaints regarding the Competition are to be directed to the Promoter.
  • Entrants must be residents of the Republic of Ireland or of Northern Ireland
  • Any questions, comments or complaints regarding the Competition are to be directed to the Promoter.

 

2.         To enter

 

2.1      Each entrant may enter the Competition by answering a simple question on the Sally Hansen Ireland Website. Competition closes on 31st December 2016.

 

2.2       Entries must be by the person submitting them and not by a third party on the entrant’s behalf        

           

2.3       No purchase, or other consideration, is necessary to enter or win this Competition.

 

2.4       The official clock for this Competition is the Promoter’s computer.

 

4.         Winner announcement

 

4.1       Winners will be notified by email from the Promoters of the competition.

 

4.2       The winners must reply to the Promoter by direct message within 72 hours  including their full name, date of birth, postal address and email address in the message so that the Promoter may arrange for them to claim their prize.

 

4.3       Winners may be required to complete, sign and return prize claim documents consisting of a declaration of eligibility, a liability release, an indemnification and a publicity release.

 

4.4       If a winner does not respond within 72 hours of the Promoter's notification email, does not return prize claim documents, the winner shall forfeit their right to receive the prize and a replacement winner will be selected.

 

  1. Eligibility

 

  1. The Competition is open to all Irish residents who are of the legal age majority in their jurisdiction of residence at the Start Date, excluding employees of the Promoter or the Administrator or any of their wholly owned subsidiaries or any marketing services agency, handling house or other company or person involved in or associated with the administration of this Competition, or any member of their households. Entrants must have a valid e-mail account and internet access as at the beginning of the Competition.

 

6.         Validity

 

6.1       Only one entry per person.  Multiple email accounts should not be used in order for a person to enter more than once. Multiple entries made by the same person from various email or other accounts or from the same IP address will not be accepted. The use of automated devices or programs is prohibited. Bulk entries from trade, consumer groups or third parties will not be accepted. Any Entrant found to breach these rules will be disqualified.

 

6.2       The Promoter accepts no responsibility for entries that are lost, damaged, corrupted, delayed, illegal or which are unable to be submitted due to software or hardware failure or for any other reason beyond its control including unavailability of the Websites.

 

6.3       Any late, corrupted, incomplete, illegal, illegible, misdirected or late entries will not be accepted.

 

6.4       Proof of submission is not proof of receipt.

 

All personal details and/or information given in the application either in this form or otherwise must be trustful, accurate and in no way misleading.

 

Entrants shall be disqualified from the competition in the event that the personal details and/or information submitted by the Entrant are untruthful, inaccurate or misleading, have failed to abide by the terms and conditions and/or are in breach of the terms and conditions.

 

7.         To win

 

7.1       The winner of the Competition will be the first entrant drawn at random after the Closing Date from all valid entries to the Competition. There shall only be one winner drawn.

 

 

  1. The prize

 

8.1       Winner will receive the Miracle Gel Collection worth RRP €350. 

 

8.2       All prizes are non-transferable.  No cash alternative is available for any prize. 

 

8.3      In the unlikely event that a prize should become unavailable, the Promoter reserves the right to substitute a prize which it may determine as being of equal or greater value.

 

 

  1. Winner publicity

 

Entrant shall allow PR, editorial and online usage of all Nailfie’s and nail tips by the Promoter at its sole discretion.

 

The Entrant agree to the unrestricted use of the nailfies and nail tips in future submissions and quotes together with his/her name by the Promotor, at its sole discretion.

 

  1. Entries

 

10.1     By entering the Competition, Entrants agree any material they submit to   the Promoter will not be returned and shall become the property of the Promoter, meaning the Promoter shall own the copyright and all other intellectual property or other right in your Selfie, future submissions and quotes generated in connection with said competition, in perpetuity and on a worldwide basis for use at the Promoter’s discretion

 

You assign to the Promoter any copyright and other Intellectual Property rights that exist in your participation in this competition, irrevocably waive any moral rights that could vest in you under the Copyrights, Designs and Patents Act 1988 and undertake to do all things necessary immediately on the Promoter’s request to effect or confirm any assignment pursuant to this paragraph.

 

10.2     If relevant, the Promoter reserves the right, but not the obligation to screen, filter and/or monitor information provided by Entrants and to edit, refuse to distribute or remove the same. Photos submitted by the Entrant may be modified/edited by the Promoter to fit in the context with the content of the relevant usage, whilst maintaining the original sentiment. 

 

 

11.       Data privacy

 

11.1     Personal information about the prize winner (name, postal address and email address) will be shared with the Promoter’s administrator to the extent necessary for prizes to be claimed by the prize winner. Accordingly, the storage of personal data –of Entrants is carried out exclusively for the participation, implementation and management of the competition. All personal data relating to the competition will be used solely for the identification of the participants and for the winning notification.

 

11. 2    The Promoter forwards the personal data of the Entrants for this purpose as stated in Paragraph 12.1 of the term and conditions of this competition to the Administrator. The Promoter entrusts the Administrator with the implementation and processing of the competition. The Promotor and the Administrator are obliged to protect these personal data of the Entrants in accordance with current UK data protection legislation (Data Protection Act 1998) and to use them only for the implementation and processing of the competition.

 

Beyond the aforementioned extent, the Promotor will not use the personal data of the Entrants of the competition nor forward it to any third party, unless the Promotor is legally bound or the Entrant has explicitly given its consent.

 

Entrants may at any time revoke their consent to use their personal data for the future. The written objection of the Entrant has to be addressed to:

The Entrant agrees to the storage, use and processing of its personal data as stated above under Paragraph 11.1 of the conditions and terms of this competition.

 

 

12.       Rules

 

 

12.1     The decision of the Promoter is final and no correspondence will be entered into.

 

12.2     In the event of any dispute regarding the conduct of the Competition and all matters relating to the Competition, the decision of the Promoter will be final and binding and correspondence or discussion will entered into only at the discretion of the Promoter.

 

12.3     The Promoter cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Competition as a result of accepting any prize.  Nothing shall exclude the Promoter’s liability for death or personal injury as a result of its negligence.

 

            Neither the Promotor nor the Administrator involved in this promotion may be liable to the winner, whether arising from tort including negligence, breach of contract, or otherwise or for any loss or damage whatsoever caused by matters relating participation in this competition, or in relation to the prizes to the extent permissible by law.

 

12.4     Events may occur that render the Competition itself or the awarding of the prizes impossible because of reasons beyond the control of the Promoter and accordingly the Promoter may at its absolute discretion vary, amend, add to or waive any of these terms and conditions, or to cancel the competition at any stage and the entrant agrees that no liability shall attach to the Promoter as a result thereof.

 

12.5     The Promoter reserves the right at any time without any liability whatsoever to modify or discontinue, temporarily or permanently, this Website and/or Competition without prior notice.

 

12.6     Entrants should retain a copy of these rules for their reference.

 

 

12.7     The Competition and Terms will be exclusively governed by Irish law and any disputes will be subject to the exclusive jurisdiction of the courts of Ireland.
